WEBSITE TERMS & CONDITIONS
Effective date: October 18, 2026
These Website Terms & Conditions (the “Terms”) govern access to and use of bachatasensual.ca, the EM Passport member portal, booking tools, account features, and related services (collectively, the “Services”).
By accessing the Services, creating an account, making a booking, purchasing a membership or product, or otherwise using the Services, you agree to these Terms and the Privacy Policy and Cookie Policy incorporated by reference. If you do not agree, do not use the Services.
1. Who we are
The Services are operated by EM Dance Academy / Bachata Sensual, operated by Queen & Andrew (“EM,” “we,” “us,” or “our”).
Business address: Queen & Andrew, 20 Maud Street, 2nd Floor, Unit 205, Toronto, ON M5V 2M5
Owner contact: queenandandrew@gmail.com
Website development team: projects@aiwebtech.co
General service contact: hello@embachatasensual.ca
2. Eligibility and accounts
You must provide accurate, current, and complete information when registering, booking, purchasing, or communicating with us. You are responsible for keeping your account information current and for protecting any login link, password, or account access method sent to you.
You may not:
- impersonate another person or provide information that is false or misleading;
- share, sell, or transfer access to your member account;
- attempt to access another person’s account or non-public staff areas;
- interfere with the security, availability, or proper operation of the Services; or
- use the Services for unlawful, fraudulent, abusive, or commercial purposes not authorized by us.
If you are under the age of majority where you live, you may use the Services only with the consent and supervision of a parent or legal guardian. A parent or guardian is responsible for a minor’s use of the Services and participation in activities.
3. Classes, events, and bookings
Schedules, instructors, locations, capacity, eligibility requirements, prices, and availability are subject to change. A booking is not confirmed until the Services display confirmation or we otherwise confirm it in writing.
We may apply eligibility rules for a class, course, workshop, assessment, team, membership, or private lesson, including level, assessment, role, capacity, membership, or approval requirements. A booking may be refused, cancelled, or moved where necessary to correct an error, prevent overbooking, comply with a safety requirement, or address suspected fraud or misuse.
A temporary seat hold may expire if payment or confirmation is not completed within the stated time. Waitlist offers may expire at the time shown in the offer email or booking interface.
4. Prices, taxes, and payment
Prices are displayed in Canadian dollars unless stated otherwise. Unless the checkout page states otherwise, displayed prices include applicable HST. The applicable price is the price shown at checkout or otherwise expressly confirmed for the relevant purchase.
Payments may be processed by third-party payment providers, including Stripe. We do not intend to receive or store complete payment-card numbers through the Services. You authorize the applicable payment provider to charge the payment method you select and authorize us to receive payment status and transaction information needed to provide the Services.
You must not use a payment method without authorization. We may suspend or cancel an order, booking, or membership if payment is reversed, declined, disputed, fraudulent, or overdue.
5. Memberships and recurring subscriptions
Memberships may renew automatically at the interval shown at checkout until cancelled. Before purchasing, review the plan, price, renewal interval, applicable tax treatment, benefits, eligibility requirements, and cancellation options displayed at checkout.
A recurring membership charge may continue until cancellation is completed. EM Passport memberships require at least 30 days' notice to cancel: the membership ends at the end of the first billing period that ends at least 30 days after the request, so a cancellation made part-way through a billing period usually includes one more payment. Benefits stay active until the end of the last paid period. One emergency pause per calendar year (up to 30 days) may be requested and is subject to approval. Pausing or cancelling ends Founding Member status and pricing, which cannot be reinstated. A payment failure may trigger retries, notices, suspension, or loss of membership benefits.
EM Vivaldi Performance Team and Ladies Intensive Training team memberships are by invitation only and require an active EM Passport membership unless the applicable plan description states otherwise. If the required Passport membership lapses, team access or related discounted benefits may be suspended or recalculated without automatically cancelling the team membership.
Membership pauses, renewal dates, founding prices, annual plans, and other plan-specific terms are governed by the offer shown at purchase and any written confirmation provided by EM.
6. Cancellations, refunds, and transfers
Unless a product page or written confirmation provides a more specific rule, the following policies apply:
- Private lessons: may be rescheduled with at least 24 hours’ notice. Late cancellations or no-shows within 24 hours are non-refundable.
- Group courses: registrations are non-refundable once the course begins, but may be transferred to a future term if requested before the second class.
- Workshops: are non-refundable, but with at least 48 hours’ notice may be transferred to another workshop date or the next available class.
- Memberships: cancellation requires at least 30 days' notice (see section 5) and does not create a retroactive refund for a period already paid, unless required by law or expressly stated at checkout.
If EM cancels or materially changes a class, event, or service, we may offer a reschedule, credit, transfer, or refund as appropriate to the circumstances. Nothing in these Terms limits any non-waivable consumer rights.
7. Participation, health, and safety
Dance and physical movement involve inherent risks, including falls, strains, collisions, and other injury. You must participate within your abilities, follow instructor and venue directions, disclose relevant limitations or injuries where requested, and stop if you feel unsafe or unwell.
As a condition of participation, you may be required to accept a separate participation waiver. The current studio policy and waiver are maintained in our participation waiver (accepted at registration). To the extent permitted by law, you assume the ordinary risks of participation and release EM and its instructors, staff, and representatives from claims arising from those ordinary risks. This does not exclude liability that cannot legally be excluded or limited.
8. Intellectual property and permitted use
The Services, including text, branding, logos, graphics, photographs, videos, software, layouts, and member-portal content, are owned by or licensed to EM or its licensors and are protected by applicable intellectual-property laws.
We grant you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose. You may not copy, reproduce, publish, sell, scrape, reverse-engineer, distribute, or create derivative works from the Services or member-only content except with our prior written permission or as permitted by law.
You retain ownership of content you submit, but grant EM a non-exclusive, worldwide, royalty-free licence to host, reproduce, process, and use it as reasonably necessary to operate, secure, improve, and communicate about the Services. You represent that you have the rights and permissions needed to submit that content.
9. Photo, video, and communications consent
You may be photographed or recorded during classes, workshops, events, or activities for promotional and social-media purposes only where you have provided the applicable consent. You may opt out in writing; an opt-out must be recorded on your student or member record to be operationally effective.
Transactional messages—such as booking confirmations, reminders, receipts, account-access links, membership notices, and service alerts—may be sent when necessary to provide the Services. Marketing messages are sent only where we have the required consent or another lawful basis, and each marketing message will include an unsubscribe method.
10. Third-party services and links
The Services may rely on or link to third-party services, including payment, email, calendar, authentication, security, mapping, hosting, analytics, or booking providers. Third-party services are governed by their own terms and privacy notices. We are not responsible for third-party services that we do not control, although we will take reasonable steps to select and manage service providers appropriate to the Services.
11. Availability and disclaimers
We aim to keep the Services accurate, secure, and available, but do not promise that they will always be uninterrupted, error-free, current, or suitable for every purpose. Schedules, prices, availability, content, and features may change without notice.
To the fullest extent permitted by law, the Services are provided on an “as available” basis. We disclaim warranties that cannot be excluded by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms removes statutory consumer protections or liability that cannot legally be excluded.
12. Limitation of liability
To the fullest extent permitted by law, EM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, revenue, goodwill, or opportunity, arising from or related to the Services.
To the fullest extent permitted by law, EM’s aggregate liability for claims arising from the Services will not exceed the greater of: (a) the amount you paid to EM for the specific service giving rise to the claim during the six months before the event; or (b) CAD $100. This limit does not apply to liability that cannot legally be limited or excluded.
13. Suspension and termination
We may suspend or terminate access to an account, booking, membership, or feature where reasonably necessary for safety, non-payment, fraud prevention, security, misuse, breach of these Terms, or legal compliance. We may also discontinue or materially change a Service.
Termination does not affect provisions that by their nature should survive, including payment obligations, intellectual-property rights, disclaimers, liability limits, dispute provisions, and privacy obligations.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted with a new effective date. If a change materially affects existing members or paid services, we will provide notice through the Services or by email where reasonably practicable. Continued use after the effective date constitutes acceptance of the updated Terms, subject to any rights you have under applicable law.
15. Governing law and disputes
These Terms are governed by the laws of Ontario and the applicable laws of Canada, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights or required dispute process, the courts located in Toronto, Ontario will have exclusive jurisdiction over disputes arising from these Terms.
16. General
If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with referenced policies and any specific purchase terms shown at checkout, constitute the agreement between you and EM regarding the Services.
17. Contact
Questions about these Terms may be sent to the owner at queenandandrew@gmail.com. For website, account, or technical support, contact the website development team at projects@aiwebtech.co. General service enquiries may also be sent to hello@embachatasensual.ca.
